Dog owner in Davao City told to shut up dogs or move them out
DAVAO CITY Vice Mayor Rodrigo R. Duterte warned Sunday pet owners especially those who have dogs to be considerate of their neighbors.
The vice mayor was reacting to a report brought to his attention regarding a certain homeowner at Morning Side Heights in Davao City, whose neighbors signed a complaint against him because of the earsplitting barking of his dogs.
In his television program “Gikan sa Masa, Para sa Masa,” Duterte urged the owner of around six to seven dogs to move his dogs out of the neighborhood before anyone thinks of suing him.
"If you are into commercial breeding of dogs in residential area, especially in a subdivision, that is a violation of a law. Having a pet, one or two dogs would do, but more than that, human dili pa jud nimo mabadlong (and you can’t even stop them from barking)... you relocate them," Duterte said.
"Dili ta ka ipiton (I will not pressure you), I am just telling you that you will be subjected to public nuisance if you will not relocate your dogs. Daghan na kaayo nagpirma sa papel, sila tanan mao ang reklamo (Many of your neighbors have already signed, they have the same complaint against you). Be considerate to your neighbors," Duterte said.
Under Article 694 of the New Civil Code, an act, omission, establishment, business, condition of property or anything else that "annoys or offends the senses" is a nuisance, and under Article 695, a public nuisance affects a community or neighborhood or any considerable number of persons.
